These T&C apply to all business relationships between PeakLeads.ch, a project of SimpleQ GmbH (hereinafter “PeakLeads”), and its customers. Amendments and collateral agreements must be in writing. These T&C are valid for an indefinite period unless changed by written agreement. The provisions of the Swiss Code of Obligations (OR) and other Swiss laws and regulations apply. If any provision of these T&C is invalid, the validity of the remaining provisions shall not be affected. In place of the invalid provision, a valid provision shall be deemed agreed from the beginning that comes closest to the economic purpose.
PeakLeads offers subscriptions for the monthly delivery of high-quality B2B leads. Customers submit their orders via the website, including the description of the required data. The delivery of the data is initially via email.
PeakLeads uses only publicly available data and strictly adheres to the Data Protection Act (DSG). By ordering personal data, customers become controllers within the meaning of the DSG. The processing and use of the data by the customer must comply with applicable data protection regulations.
The payment terms are specified on the invoices. Prices are net, payable within 30 days from the invoice date, unless otherwise agreed.
The subscription can be canceled at any time in writing by sending an email to info@peakleads.ch. The subscription ends automatically when there are not enough leads available that meet the search criteria. The customer will be notified by email about the end of the subscription.
PeakLeads is only liable for damages caused by gross negligence or intent. No guarantee is given for the postal accuracy and correct target group affiliation of the data or for the completeness of the files, provided that an industry-standard error rate is not exceeded.
The delivered data may only be used for the customer’s own use. Any paid or unpaid transfer to third parties is not permitted.
The place of jurisdiction and performance is the registered office of SimpleQ GmbH. Swiss law applies. Should individual provisions of these T&C be invalid, the validity of the remaining provisions shall remain unaffected. Amendments and additions to these T&C must be in writing.
